We were trying to hire as much as possible and had very limited resources. And every attorney you assign to a case means you can&#8217;t do another case,&#8217; he said according to the transcript from October 24.<\/p>\n<p>Estrada was detailing a phone call he had with David Weiss in October 2022 &#8211; who is the lead criminal investigator into Hunter Biden&#8217;s gun and tax crimes. He was appointed special counsel in August by Attorney General Merrick Garland after the whistleblowers came forward.\u00a0<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter\" src=\"https:\/\/i.dailymail.co.uk\/1s\/2023\/10\/23\/23\/76910631-12663561-image-a-10_1698098880346.jpg\" height=\"939\" width=\"634\"><\/p>\n<p>Martin Estrada is an American lawyer who serves as the United States Attorney for the Central District of California since September 2022<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter\" src=\"https:\/\/i.dailymail.co.uk\/1s\/2023\/10\/26\/22\/76937665-0-image-a-17_1698354353132.jpg\" height=\"455\" width=\"634\"><\/p>\n<p>The House Judiciary Committee is run by Rep. Jim Jordan, R-Ohio<\/p>\n<p>During the call Weiss, the U.S. attorney in Delaware, asked Estrada to partner with him on Hunter&#8217;s case &#8211; which he declined.<\/p>\n<p>&#8216;And it seemed and he didn&#8217;t push back on when I told him the situation, that we wouldn&#8217;t be co-counseling, but he did express appreciation when I offered administrative support,&#8217; Estrada told members and staff on Tuesday.<\/p>\n<p>He went on to say that although he declined to prosecute the case, he felt it would be &#8216;immaterial&#8217; to whether Weiss ended up bringing charges &#8211; which he originally did not.<\/p>\n<p>Estrada also maintained he &#8216;never&#8217; took any steps to block Weiss from pursuing charges against Hunter in California.\u00a0<\/p>\n<p>Weiss charged Hunter last month with three felony counts related to lying on a federal gun application form while under the influence of drugs. He faces up to 25 years in prison and pleaded not guilty.<\/p>\n<p>The new not guilty plea comes after what Republicans called a &#8216;sweetheart&#8217; plea deal &#8211; that would have seen Joe Biden&#8217;s son avoid jail time &#8211; collapsed this summer.<\/p>\n<p>Republicans including House Judiciary Chairman Jim Jordan have pointed out discrepancies between Attorney General Merrick Garland and U.S. Attorney Weiss&#8217; public statements on the Hunter Biden case and who had &#8216;full authority&#8217; to charge the president&#8217;s son.\u00a0<\/p>\n<p>Estrada told investigators that he did not agree with the characterization that Weiss had &#8216;ultimate authority&#8217; to bring charges in any district &#8211; before he was appointed special counsel.<\/p>\n<p>&#8216;I thought [Weiss] had authority to bring the charges wherever he chose to when he was U.S. Attorney and certainly as he is now special counsel,&#8217; stated Estrada.\u00a0<\/p>\n<p>But when further pressed about the exact definition of ultimate authority, he backtracked and called the phrase &#8216;vague.&#8217;\u00a0<\/p>\n<p>Estrada also said that only the attorney general holds the &#8216;ultimate authority&#8217; for the entire Department of Justice.<\/p>\n<p>Whistleblowers Ziegler and Shapley also testified that Weiss asked U.S. Attorney for D.C. Matthew Graves to bring &#8216;felony and misdemeanor tax&#8217; charges agains the president&#8217;s son.\u00a0<\/p>\n<p>But after Graves refused, Weiss threw out the potential felony charges and struck a plea deal with the president&#8217;s son that did not include any jail time.\u00a0Hunter is expected in court Wednesday for the plea deal to be made official.<\/p>\n<p>&#8216;I watched U.S. Attorney [David] Weiss tell a room full of senior FBI and IRS senior leaders on October 7, 2022, that he was not the deciding person on whether charges were filed,&#8217; Shapley said, contradicting Weiss&#8217; previous public statements.<\/p>\n<p>&#8216;If the Delaware U.S. Attorney David Weiss followed DOJ policy as he stated in his most recent letter, Hunter Biden should have been charged with a tax felony, and not only the tax misdemeanor charge,&#8217; said Ziegler.<\/p>\n<p>&#8216;We need to treat each taxpayer the same under the law.&#8217;<\/p>\n<p>Graves has denied allegations that he contributed to improper political interference during the federal investigation into Hunter Biden.<\/p>\n<p>According to a transcript reviewed by DailyMail.com, Graves said he was &#8216;surprised&#8217; in the criminal gun and tax case against the president&#8217;s son.<\/p>\n<p>He explained that as the U.S. attorney for Delaware, his charging authority is normally &#8216;geographically limited&#8217;
